2. PHYSIOTHERAPY SERVICES VS EDUCATIONAL CONTENT
It is critical to understand the distinction between our services.
Physiotherapy services (in-clinic or online) involve individual assessment and treatment provided by a registered physiotherapist.
Educational products and resources (including programs, books, videos and written materials) are provided for general informational and educational purposes only. These do not constitute personalised physiotherapy, medical advice, diagnosis or treatment.
Purchasing or accessing educational content alone does not create a physiotherapist–patient relationship.
A physiotherapist–patient relationship is only formed where:
- You book and attend an in-clinic or online physiotherapy appointment; and
- We explicitly agree to provide physiotherapy services to you.
3. MEDICAL DISCLAIMER
All information provided through The Physio Don — including programs, videos, documents, written materials, and online resources — is for general educational purposes only.
This content is not a substitute for personalised medical advice, diagnosis or treatment.

4. ONLINE (TELEHEALTH) PHYSIOTHERAPY DISCLAIMER
Online physiotherapy is delivered via secure video platforms and does not involve hands-on assessment or treatment.
You acknowledge that:
- Telehealth is not suitable for all conditions
- Physical examination is limited compared to in-clinic care
- You are responsible for ensuring a safe environment when exercising
- You must follow all advice within your own physical limits
We reserve the right to determine whether online physiotherapy is clinically appropriate and to decline, limit or discontinue telehealth services where necessary.
5. ELIGIBILITY
You must be at least 18 years of age to use our website, content, programs or services.
Where physiotherapy services are provided to minors in-clinic, this occurs only with appropriate parent or guardian consent and in accordance with Australian healthcare requirements.
6. BOOKINGS, PAYMENTS AND REFUNDS
All prices are listed in Australian dollars unless otherwise stated. Unless expressly stated at the point of booking or purchase:
- All purchases are one-off payments
- Payments are non-refundable
- Access to digital products is granted upon purchase
Any refund, cancellation or rescheduling terms applicable to physiotherapy appointments or specific products will be clearly communicated at the time of booking or purchase.
Payments are processed via secure third-party payment providers. We do not store your payment details.
7. INTELLECTUAL PROPERTY
All content, including text, videos, programs, images, branding and publications, is owned by Suffolk Enterprises Pty Ltd unless otherwise stated.
You may not copy, reproduce, distribute, modify or resell any content without prior written permission. Personal, non-commercial use only is permitted.
8. TESTIMONIALS AND RESULTS DISCLAIMER
Testimonials and reviews reflect individual experiences only.
Results vary between individuals and depend on many factors including health history, consistency, adherence and individual circumstances. No specific outcomes or results are guaranteed.
9. LIMITATION OF LIABILITY
To the maximum extent permitted by Australian law, Suffolk Enterprises Pty Ltd and The Physio Don are not liable for any indirect, incidental or consequential loss arising from your use of our services, content, programs or products.
Your sole remedy for dissatisfaction is to stop using the services.

Our services may be accessed online from outside Australia. By using our services, you agree that Queensland law applies and that any disputes will be subject to the exclusive jurisdiction of the courts of Queensland, Australia, to the maximum extent permitted by law.
13. BUILT TO LAST APP ACCOUNTS

When creating an account, you agree to provide accurate and complete information and to keep that information current.
You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.
We reserve the right to suspend or terminate accounts where fraudulent activity, misuse, abuse, or breaches of these Terms are identified.

14. BUILT TO LAST PROGRAM ACCESS
Access to the Built To Last Program is provided through our online platform.

Access is granted subject to payment status and compliance with these Terms.

15. FREE TRIALS AND AUTOMATIC BILLING
The Built To Last Program may be offered with a free trial period.
Where a free trial is offered:
- Users must provide valid payment details before accessing the trial.
- No charge is taken at the commencement of the trial.
- Users may cancel at any time before the trial period expires.
- If cancelled before expiry, no payment will be processed.
- If not cancelled, the nominated payment method will be automatically charged at the end of the trial period.
- Successful payment unlocks continued access to the full program.
Users are responsible for ensuring their payment details remain current and valid.
Failed payments may result in suspension or restriction of access until payment issues are resolved.
16. PLATFORM AVAILABILITY
While we aim to provide uninterrupted access to our online platform, we do not guarantee continuous availability.
The platform may be temporarily unavailable due to:
- Maintenance
- Updates
- Technical issues
- Third-party service interruptions
To the maximum extent permitted by law, we are not liable for losses arising from temporary interruptions to platform access.
